Please read carefully the following terms and conditions (" Terms and Conditions ") before ordering any goods or services on this website. You agree to be bound by these Terms and Conditions by ordering any goods or services from this website.
Section 1: Acceptance
Please read the Terms and Conditions carefully. By accessing our TravelEats platform, you are agreeing to these Terms. You may not use the Services if you do not accept the Terms.
These Terms are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the TravelEats website at https://traveleats.eu and any related mobile or software applications including but not limited to delivery of information via the website whether existing now or in the future that link to the Terms.
In order to use the Services, you must first agree to the Terms. You can accept the Terms by:
Clicking to accept or agree to the Terms, where it is made available to you by TravelEats in the user interface for any particular Service; or
Actually using the Services. In this case, you understand and agree that TravelEats will treat your use of the Services as acceptance of the Terms from that point onwards.
Section 2: Definitions
2.3 “Customer”,"You"," Your" and "Yours" are the person accessing this website and ordering any Goods or Services from the site
2.4 "We","Us","Our" and "TravelEats" are company references
2.5 "Participating Restaurant" is a third party agreed to cooperate with the company for the preparation and delivery of the Goods or Services via the Platform
2.6 “Platform” is the website (s), apps, tools and other devices of TravelEats on which the Service is made available
2.7 "Food Delivery" refers to perishable/consumable goods provided by our participating restaurants.
2.8 “Service” is the commercial service and offers advertised by TravelEats to the customer about the product and restaurant on the platform.
Section 3: Ordering
3.1 You may be required to provide an e - mail address and password when ordering from this website. You must ensure that you keep the combination of these details safe and do not supply third parties with this information.
3.2 Any order you place with us depends on availability of products, delivery capacity and acceptance by the participating restaurant. We will send you an e-mail confirming that we have received your order online. This e - mail confirmation is automatically produced so you have your order details confirmed.
3.3 Any order for the supply of Food Delivery from this platform is between you and the Participating Restaurant
3.4 If the ordered delivery and delivery capacity is available, the Participating Restaurant will accept and confirm the order with us. If the order details are correct, the order for the delivery of food, goods or services is confirmed by Email..
3.5 If you choose to pick up the order, you must be present at the pick up location of the Participating Restaurant at the chosen time, which is shown in the confirmation mail, text message or on the platform.
3.6 In connection with information on the status of your order, you must be available to both the Participating Restaurant and TravelEats via telephone or e - mail (as indicated when placing the order).
3.7 The order can only be delivered by the restaurant if the customer provides full and correct contact details and addresses while placing the order. The customer is obliged to inform TravelEats or the restaurant without delay of any inaccuracies in the stated details.
Section 4: Payment and Pricing
4.1 At the time of order you are obliged to pay to the Participating Restaurant by online payment in the website.
4.2 The Restaurant authorized TravelEats to receive online payment on behalf of the Restaurant from the Customer.
4.3 All prices shown on the website are correct at the time of publication and have been entered as received from the restaurant at the time of listing; although we are very careful to keep them up - to - date, the final price charged by the restaurant may change at the time of delivery based on the latest menu.
4.4 The final tax invoice is issued by the participating restaurant and shipped with the order to the customer.
4.5 If you decide to pay online, you have to pay for your order before it is delivered. To ensure that online shopping is safe, your debit / credit card details are encrypted to prevent someone from reading them when they are sent over the internet.
Section 5: Delivery
5.1 Delivery periods quoted at the time of ordering are approximate estimations and may vary. Order will be delivered to the address designated by you at the time of ordering.
5.2 It is the Participating Restaurant’s sole responsibility to deliver the order on time.
5.3 Participating Restaurants who prepare your order aim at, delivering the order to you at the place of delivery as requested by you, deliver within the time confirmed by the Participating Restaurant, to inform you if there are any unexpected delays in delivering you the food.
5.4 Restaurants participating and we are not responsible for any losses, liabilities, costs, damages, charges or expenses arising from the late delivery.
5.5 Please note that participating restaurants may not be able to be delivered to certain locations. If this is the case, our participating restaurants or we will inform you using the contact details provided by you at the time of order, to arrange for a cancellation or to deliver to an alternative address within the restaurants reach.
5.6 If you fail to accept the delivery at the designated location or we cannot deliver the food due to your failure to provide appropriate location details then such order/goods shall be deemed to have been delivered to you.
5.7 It is Customer's responsibility to find out if the Host (Hostel , Hotel, Bed and Breakfast and any other vacation/tourist rental places) allows outside food delivery.
Section 6: Cancellation of the Order
6.1 You cannot cancel the order unless it is explicitly mentioned on the Platform by the Participating Restaurant that Cancellation of the order by the customer is possible.
6.2 If the item you ordered is not available for any reason, we may cancel a contract. If this is the case, we will inform you and return any payments you have made.
6.3 In the unlikely event that the Participating Restaurant delivers a wrong item, you have the right to reject the delivery of the wrong item and you shall be fully refunded for the missing item.
6.4 If the Restaurant does a partial delivery, it has the obligation to inform you aprior and seek for a replacement of missing items. You have the right to refuse a partial order before delivery and get a refund. We are not responsible for wrong or partial delivery. The issue has to be settled directly with the Participating Restaurant.
6.5 If you place a false or misleading Order by providing incorrect contact details or pick-up location or delivery location then We have the right to refuse future orders from you.
Section 7: Complaints
7.1 We take complaints very seriously and strive to respond and resolve within 5 business days
7.2 All complaints must be addressed to our support service by writing in e-mail.
